About the Course

The presentation discussed Trafficking in Persons (TIP), beginning with its definition and the elements required for a situation to be considered under Republic Act No. 9208, as amended by R.A. 10364. It explained the acts punishable under the Anti-TIP Law and distinguished between ordinary and qualified trafficking. The discussion also included what constitutes attempted trafficking and identified the persons authorized to file complaints for violations of the law. Updates brought about by Republic Act No. 11862 or the Expanded Anti-Trafficking in Persons Act of 2022 were also presented. The presentation concluded with an overview of relevant Supreme Court cases that illustrate the application of the law in real situations. Overall, the session aimed to deepen understanding of the legal framework and enforcement of anti-trafficking measures in the Philippines.

Lecturer: Silva, Judge Emmanuel A.

Judge Manny Silva is a long-time professor of commercial and remedial law at the Manuel L. Quezon University School of Law and the University of Manila. He currently serves as presiding judge of the Regional Trial Court of Mariveles in Bataan. Prior to that, he presided over the Municipal Circuit Court in Orion-Pilar, Bataan and served as public prosecutor at the Philippine Supreme Court in Manila. He obtained a masters of law degree in international commercial transactions from the University of San Francisco School of Law and a masters degree in public management from the Ateneo School of Government. He holds a Diploma in Real Estate Management granted by CREBA and De La Salle College of Saint Benilde. Prior to public service, he was senior partner at the Villaflor Nicolas Caparas and Silva Law Offices and was a bank lawyer for close to two decades, having worked as senior legal of China Bank and the Urban Bank, and as Assistant Vice-President and head of the legal and remedial management group of the Export and Industry Bank.
